The file does exist but it's at the top level and then copied into place with modman as that was historically our way of installing Magento 1 extensions.

I think it's reasonable to move it so if we keep this file, could you update the PR to delete the one at root of the repo (note that the one at the root is slightly better as it declares its dependency on the Mage_Cms module), and update the modman file with the new file that needs to be copied into place.
